Jacobson recently spoke on the Esports Trade Association‘s panel exploring “Employment Contract Formation Among Esports Teams and Esports Talent” with immigration attorney, Pablo G. Velez, Esq. The panel explored the differences between “independent contractor” and “employee” classification, the various elements and important criteria that fact-finders review when making an analysis as well as focused on the repercussions of misclassification. The discussion continued by exploring common clauses in esports player and talent agreements with professional esports teams and organizations, including an analysis on some negotiation techniques and tactics for forming such contractual arrangements.
